The Med Arb RB Chairman is qualified to act as the appointing authority in case of request of the interested parties, thus being responsible for the appointment of the arbitrators in arbitration procedures and ad hoc mediation, in addition to dispute boards. Such assignment is defined according with terms of article 7, g, of the internal Regulation of Med Arb RB. For such service, the value included in the Table of Costs shall be charged.

The need of indicating an appointing authority in an ad hoc proceeding has a significant difference between the preparation of an institutional arbitration clause and an ad hoc arbitration clause. In the first case, the institution chosen is responsible for appointing or replacing arbitrators when the parties are silent about that. As for the second case, there is no institution managing the procedure, and the litigants are required to indicate an appointing authority within the ad hoc scope to appoint or replace arbitrators.

The appointing authority can be an arbitration institution, a judicial, business, or professional agency, or a neutral entity. The parties may choose an organization or a position (for example, the chairman of an arbitration institution, the presiding judge of a state court, or the chairman of a business or professional entity) and not an individual (since he/she can be unable to act when invited to do so). The parties shall also ensure that the chosen authority will agree to perform such roles, if and when invited to do so.

Performance of Med Arb RB as the appointing authority

In cases in which the Med Arb RB Chairman acts as the appointing authority in arbitration procedures, mediations, and ad hoc dispute prevention and settlement board, the value indicated in the table of costs of Med Arb RB shall be charged.
